This Law enters into force on the date of its official publication.
Abstract

The scope of this Law shall be to regulate relations concerning protection of genetic diversity of agricultural crops in the territory of Mongolia, testing of plant varieties, ensuring quality control and monitoring of seeds, and setting up reserve fund of seeds. It establishes a gene pool of cultivated plants for the purpose of increasing, storing, protecting and breeding plant genetic resources. The gene pool reserves of plants shall comprise breeding and local varieties, hybrids, local samples and foreign varieties. The gene pool reserve of the plant varieties shall be owned by the state and the specialized agencies authorized by the state central administrative organization in charge of agricultural matters, which shall reorganize, renew and use them. The gene pool reserve of the plant varieties shall be set up by the state with a view of protecting seed producers who are unable to stockpile seeds due to natural disasters. Natural persons, business entities and organizations engaged in seed production shall be granted the following rights and duties: (a) to produce seeds and hybrids by order and in accordance with contract concluded with the authorized state body in the field of agriculture; (b) apply to the competent authority for confirmation of new breeds; (c) register and deposit new breeds; (d) to insert produced seeds in control and quarantine system; (e) to trade certified seeds of plant varieties and hybrids; (f) to import seeds conforming with the national standards; and (g) to certify plant varieties of agricultural crops on farmland. This Law consists of II Chapters divided into 10 Articles. Chapter I lays down general provisions. Chapter II regards quality control of seeds and plant varieties of agricultural crops.
