Abstract The Act sets up the Seed and Seedling Registration and Certification Research Institute, that will supervise and regulate the identification of both new plant varieties and breeders' rights, as well as issue a patent for the newly certified registered seed and seedling varieties. Article 3 refers to non improved and wild plant genetic resources, whose patenting procedures shall be restricted to the State. Further the Act establishes that varieties prevalent in the country shall be given priority in the registration process. As per Note of Article 11, the provisions of this Act do not apply to varieties entering the country as foreign samples destined to research in the competent institutes and universities.
