Abstract This Law determines the legal basis of the state policy in the sphere of control over the circulation of narcotic drugs, psychotropic substances, precursors and establishes the norms of counteraction to their illegal circulation in order to protect public health, state and public security. Narcotic drugs - substances of synthetic or natural origin, their preparations, including medicines, as well as plants included in the list of narcotic drugs, psychotropic substances and precursors subject to control in accordance with the law and the international treaties to which Turkmenistan is a party, including the Single United Nations Convention on Narcotic Drugs of 1961. Cultivation of plants containing narcotic substances - planting and growing narcotic plants included in the List of Narcotic Drugs, Psychotropic Substances and Precursors Subject to Control in Turkmenistan in accordance with international conventions. Collection of plants containing narcotic drugs and psychotropic substances - collection of wild or cultivated drug-containing plants listed under the international conventions. The state policy in the sphere of turnover of narcotic drugs, psychotropic substances, precursors and in the sphere of counteraction to their illegal turnover and consumption is aimed at: (a) state regulation of the circulation of narcotic drugs, psychotropic substances and precursors and prevention of their illicit circulation and consumption; (b) state control over the circulation of narcotic drugs, psychotropic substances and precursors; (c) state licensing of the circulation of narcotic drugs, psychotropic substances and precursors; (d) state registration of the circulation of narcotic drugs and psychotropic substances authorized in Turkmenistan; (e) interdepartmental and intra-departmental coordination of the activities of enterprises (institutions) in the field of circulation of narcotic drugs, psychotropic substances and precursors; (f) comprehensive solution of tasks related to the organization of work aimed at suppressing the illicit trafficking and consumption of narcotic drugs, psychotropic substances, precursors; (g) improvement of the work of the bodies carrying out operational-search activities to identify and suppress crimes related to illicit trafficking and consumption of narcotic drugs and psychotropic substances; (h) promotion and approval of healthy lifestyles and comprehensive measures to prevent and combat drug addiction; (i) involvement of voluntary associations, religious organizations and Turkmen citizens in combating the spread of drug addiction and related offences; and (j) strengthening of international cooperation on a multilateral and bilateral basis in the field of control of trafficking in narcotic drugs, psychotropic substances and precursors and implementation of measures to prevent their illicit trafficking and consumption. All produced and manufactured narcotic drugs and psychotropic substances must have external and internal packaging and labelling corresponding to the requirements established by the Ministry of Health and Medical Industry. Narcotic drugs and psychotropic substances may be circulated in Turkmenistan after their state registration in accordance with the procedure established by law. Cultivation of the plants included in the List, except in the cases provided for by this Law, is prohibited in the territory of Turkmenistan. Cultivation of plants included in the List is authorized only for enterprises (institutions) in the amounts not exceeding the established state quotas. The procedure for issuing permits for the cultivation of plants on the List and their use solely for industrial, medical and scientific purposes is established by the Cabinet of Ministers. This Law consists of IX Chapters divided into 54 Articles. Chapter I lays down general provisions. Chapter II regards state regulation and organization of the activities in the field of circulation of narcotic drugs, psychotropic substances and precursors. Chapter III regards development, manufacturing and preparation of narcotic drugs and psychotropic substances. Chapter IV establishes the procedure for state registration of narcotic drugs and psychotropic substances. Chapter V regards circulation of narcotic drugs, psychotropic substances and precursors. Chapter VI regards use of narcotic drugs and psychotropic substances. Chapter VII regards suppression of illegal trafficking of narcotic drugs, psychotropic substances and precursors.
