It therefore applies exclusively for excavations (Annex, No. 2), road construction (Annex, No. 3), cableway construction (Annex, No. 4), skiing tow lifts (Annex, No. 5) and ski slope construction (Annex, No. 8). These specific project plans are marked either as obligatory environmental impact assessment project plans, as general preliminary examinations on an individual case-by-case basis in accordance with the law, or as location-related preliminary examinations on an individual case-by-case basis in accordance with the EIA law. The state is entitled to add new project plans to the list in the Annex through enactment of a regulation, where projects may have significant impacts on the environment due to their nature, scope or size (§ 1, (2)1.). The state is also entitled to remove project items from the annex list where there is deemed no significant impact on the environment to current knowledge and under the supervision of the European Union Commission.
