Abstract The scope of this Law is to protect the seeds of cultivated plants, to promote seed sector research, analysis and innovation, fair trade in seeds, protection of genetic resources, creation of new varieties of cultivated plants, protection of breeders’ rights, with a view of ensuring food safety. It shall be applicable to seeds and plant varieties either of national origin or imported to Mongolia. Seed breeding shall be subject to licensing and certification. Licenses for seed production shall be issued to business entities. Seed producers shall have the following obligations: (a) seed samples must be inspected by accredited seed laboratory; (b) seeds and plant varieties must be inspected and certified at seed production site; (c) in case of seeds of protected plant varieties seed producer must obtain the manufacturer’s permission; and (d) seeds and plant varieties must be localized and registered in the National Register of Plant Varieties and seeds of perspective plant varieties must be proliferated according to the breeding scheme. Seeds that meet the requirements of the relevant standards and are certified shall be authorized for trade on the territory of Mongolia. During transportation and storage seeds must be packaged and labelled specifying the name of seed variety, origin, quality, information of sterilization and if protected by the right of manufacturer. Seeds shall be authorized for import and export if they meet the requirements of relevant standards, registered and certified. Each variety shall be attributed name permitting its identification. The period of validity of breeders’ right to plant varieties shall be 20 years, and for trees and creeping plants the period of validity shall be 25 years. This Law consists of IX Chapters divided into 31 Articles. Chapter I lays down general provisions. Chapter II regards seed production. Chapter III regards seed quality control and certification. Chapter IV regards seed trade. Chapter V regards plant variety registration. Chapter VI regards protection of cultivated plant varieties. Chapter VII establishes fund of genetic resources of food plants and agricultural crops. Chapter VIII establishes the functions of state organizations related to seeds and varieties.
