Abstract

This Law establishes that object of lease of land shall be land plots pertaining to ownership of natural and legal persons, municipal and public ownership. Leaseholders of land plots can be the following categories: (a) regional, provincial and city administration within plenary powers envisaged by acting legislation; (b) public administration of rural areas; and (c) natural and legal persons of Ukraine, foreigners and stateless persons, foreign legal persons and international associations and organizations, and foreign states. The right of lease of land shall be subject state registration in accordance with acting legislation. Lease of land shall be regulated by contract that shall contain data related to the object of lease (cadastre number and location of the plot of land), period of lease, rent, purpose of lease and purposeful use of land, terms and conditions of restitution of plot of land to lessor, and liability of the Parties. The leased land plot or its part may be subleased by the lessee without changing the specific use thereof, if it is envisaged by the lease agreement or with the written consent of the lessor (except as provided by law). If the landlord does not send a written notice of consent or objection within one month, the leased land or part of it may be subleased. The terms of the land sublease agreement must be limited to the terms of the land lease agreement and not contradict it. The term of the sublease may not exceed the term specified in the land lease agreement. In case of termination of the lease agreement, the sublease agreement of the land plot shall be terminated. The right to sublease land is subject to state registration. The essential terms of the land lease agreement shall be as follows: (a) lease object (cadastral number, location and size of the land plot); (b) date of conclusion and term of the lease agreement; and (c) rent with an indication of its amount, indexation, method and conditions of calculations, terms, procedure for its payment and revision and liability for non-payment. By agreement of the parties, other conditions may be specified in the land lease agreement. This Law contains IX Sections divided into 37 Articles. Section I lays down general provisions. Section II deals with land lease contract. Section III regards lease payment for land. Section IV establishes rights and obligations of lessors and tenants, protection of their rights. Section V regards modification, termination and renewal of land lease contract. Section VI regards dispute settlement and establishes responsibility of the parties for failure to comply with the obligations of the land lease contract. Section VII regards international agreements. Section VIII lays down final provisions. Section IX lays transitional provisions.
