Abstract The present Law regulates property and personal non-property relations connected with creation, legal protection and utilization of selection achievements of plant variety. The right to selection achievement shall be protected by Law and shall be confirmed by patent. Patent shall confirm the right of patent owner to use selection achievement. Selection achievement covered by patent shall be recorded in the State register. The validity of shall be of 20 years from the date of recording in the State register. The validity of patent for grape, fruit species and forest species shall be of 25 years (art. 4). The criteria for legal protection of selection achievement shall be novelty, uniformity and stability (art. 5). Application for obtaining patent shall contain application form and description of selection achievement (art. 6). The following uses shall not be considered violation of the patent owner’s rights: 1) use of selection achievement for persona land non-commercial purposes; 2) use of selection achievement for experimental purposes; 3) use of selection achievement for the production of new plant variety (art. 15). The authorized institution shall publish periodically the official bulletin of selection achievements (art. 19).
