Abstract

This Law lays down special land use conditions, specifying the areas in which these conditions shall be applied, defining the territories and establishing the rights and obligations of the persons involved in this process, the legal preconditions for the centralized registration of the defined territories in the Real Estate Register of the Republic of Lithuania. The purpose of this Law is to ensure public health safety, protection of the objects or activities from adverse factors or effects, including natural disasters (flooding, oil pollution, animal diseases) ensuring state security, protection of the environment and public interest in the territories specified in this Law. Special conditions for the use of land, as specified in this Law, shall be intended restrictions on economic and/or other activities depending on the geographical area apply to location, proximity, main land use, land use, specific activities, buildings, immovable cultural heritage and environmental protection, public health, national security and public interest needs. In the process of preparation of land-use planning documents, land management projects, buildings or other projected activities, economic and/or other activities must comply with all special land use conditions applicable in the specific areas. The consent of the landowner, the state or municipal land trustee shall not be required, when, in the public interest, the territories specified in this Law are determined by territorial planning documents or land management projects or plans, maps and/or diagrams of these areas. Special land use conditions applicable to a plot of land, newly formed in accordance with approved land-use planning documents and/or land management projects, shall apply from the date of entry of the territories specified in this Law into the Real Estate Cadastre. Compensation for the application of special land use conditions in the areas designated in the public interest, where the landowner, public or private consent of the municipal land trustee is not required, shall be calculated and paid, in accordance with the procedure established by the Government, once-only or for the maximum period of three year with annual payments. The protection zone for a permanent anthrax outbreak is established in the area of anthrax outbreak. The protection zone of the permanent anthrax outbreak consists of a 3-meter-wide strip of land around it with a permanent anthrax mark from the outer boundary of the area of anthrax outbreak. Any economic and/or other activity is prohibited in the protection zone of a permanent anthrax outbreak area. Special land use conditions shall be applicable to the territories containing cultural heritage objects and areas and their protection zones. In nature reserves (protected areas) it is prohibited to change the main conservative land use purpose and shall be prohibited economic and other activities, except for scientific research. Conversion of forest land use into other land uses shall be prohibited. It is prohibited to plow, drain or otherwise alter the condition of natural grasslands and pastures and planting or afforestation in the aforesaid areas. In the case of agricultural land, the following use restrictions shall apply for soil protection purposes: (a) arable land with a higher soil productivity than the national average, as well as land in which drainage systems are in operation must be used in such a way that their area is not reduced, with the exception of ecologically depleted natural areas, and without deteriorating soil properties; (b) agricultural land withe soil affected by wind and water erosion must be used with the application of a set of anti-erosive measures; (c) land use areas consisting of soils of protective importance for soil and water and ecologically valuable forests and plantations of trees and shrubs marked by land-use planning documents or land management projects must be used in the context of the landscape formation and environmental protection requirements; and (d) during excavation work, the destruction of the fertile layer of soil is prohibited.
