Abstract

This Law establishes the main forms of employment and their system for job seekers, the legal basis of the employment support system for persons, its purpose, tasks, employment policies, the provision of labor market services, organization and financing of the implementation of support measures, liability for illegal work, violation of the employment procedure of aliens, undeclared work and undeclared self-employment activities. The provisions of this Law are applicable to: (a) citizens of the Republic of Lithuania, the European Union or of the European Free Trade Association and their family members residing in the Republic of Lithuania; (b) citizens of the Republic of Lithuania, the European Union or of the European Free Trade Association and their family members residing in another European country, in a member state of the Union or of the European Free Trade Association; (c) non-European holders of a residence permit in the Republic of Lithuania and persons who have been granted a transfer person status; and (d) employers with permanent seat in the Republic of Lithuania and employers-natural persons who are permanent residents of the Republic of Lithuania. Liability for illegal work, violations of the procedure for employment of aliens, undeclared work and undeclared self-employment apply to all persons working in the territory of the Republic of Lithuania. The provisions of this Law are harmonized with the European Union laws specified in the Annex to this Law. A person is considered employed if he is employed on the bases of a comparable legal relationship. In case of the declaration of state of emergency or quarantine, during which restrictions on economic activities are imposed, self-employed persons are entitled to benefits for self-employed persons. In case of the declaration of state of emergency or quarantine, a person engaged in an individual agricultural activity is entitled to a lump sum payment of euro 200. Individual agricultural activity is an activity carried out by a natural person who has registered and agricultural holding, a farmer’s holding, a farmer’s holding or livestock or has become a partner of a farmer or a partner of agricultural holding. The Government of the Republic has the following competence in the field of employment: (a) submittal to the Parliament for implementation of draft laws regulating employment support policy; (b) approval of state employment increase programs and adoption of resolutions necessary to support employment; and (c) coordination of the activities of ministries, other state institutions and establishments related to employment promotion. The employment promotion policy shall be implemented by the Employment Service. Labor market services provided for in this Law shall be provided to the following categories: (a) unemployed persons; (b) persons working under an employment contract or employment relationship with equivalent legal status; (c) self-employed persons; and (d) employers. An unemployed person is a person who meets at least one of the following conditions: (a) is unemployed; (b) engages only in unpaid employment activities; and (c) is unoccupied. The following support shall be provided for job creation: (a) subsidization of job creation (adaptation); (b) implementation of local employment initiative projects; and (c) promotion of self-employment.
