Abstract

The Criminal Code of the Republic of Armenia is based on the Constitution of the Republic of Armenia and on principles and norms of international law. The tasks of the Criminal Code of the Republic of Armenia are the protection of human rights and freedoms and citizen, rights, property of legal entities, environment, public order and public security, constitutional order, peace and security of the population from criminal offenses, as well as crime prevention. Penal Code consists of 15 Sections divided into 398 Articles. Chapter 19 deals with crimes against constitutional rights and freedoms of human beings and citizens. It punishes violation of human and civil rights and freedoms, depending on nationality, race, gender, language, religion, political or other views, social origin, property or other status, causing harm to legal interests of the person. Articles 155-158 deal with labour issues, applying penalties for coercion to participate in a strike or to refuse to participate in a legal strike, unjustified refusal to hire or unjustified dismissal from work of a pregnant woman or a person with child under age of three years. Article 159 prohibits illegal use of patent rights. Articles 187-188 punishes obstruction of legal entrepreneurial and other legal business entities and punishes illegal business activities. Article 197 prohibits illegal use of trademarks, service marks and company names. Article 207 prohibits manufacturing and trade of counterfeit wine, vodka and liquors. Article 212 protects consumers against fraudulent trade practices. Articles 227-228 deal with offences related to violation of rules related to nuclear power facilities, radiation, sources of ionizing radiation and illegal handling of radioactive materials. Article 273 prohibits illegal sowing of cultivation of prohibited crops, containing narcotic, psychotropic, potent or poisonous substances. Articles 277-278 punish violation of sanitary and epidemic rules that could harm public health. Section 10 (Articles 281 – 298) punishes violation of rules and regulations related to environmental protection, in particular concealment or deliberate distortion of information on environmental pollution, violation of safety rules when handling hazardous chemical or biological substances, veterinary and plant protection regulations, air and water pollution, soil pollution, offences related to protection and management of subsoil, poaching of wild fauna species and fish stocks, destruction of habitats and illegal logging.
