This Law enters into force on the date of its promulgation.
Abstract

The scope of this Law is to ensure the implementation of the provisions of Article 29 of the Constitution of the Republic of Lithuania establishing the equality of persons and the prohibition of restricting human rights and granting them privileges based on sex, race, nationality, language, origin, social status, religion, beliefs or views. This Law establishes the legal bases and powers for the activities of the Equal Opportunities Ombudsman of the Republic of Lithuania and the Monitoring Committee for the Rights of Persons with Disabilities under the Office of the Equal Opportunities Ombudsman, as well as the submission and investigation of complaints. Equal opportunities shall be intended implementation of human rights enshrined in international human and civil rights documents and laws of the Republic of Lithuania regardless of gender, race, nationality, citizenship, language, origin, social status, religion, beliefs or opinions, age, sexual orientation, disability, ethnicity, religions. State and municipal institutions and establishments shall, in accordance with their competence: (a) ensure that all legal acts establish equal rights and opportunities regardless of gender, race, nationality, citizenship, language, origin, social status, religion, beliefs or opinions, age, sexual orientation, disability, ethnicity, religion; (b) develop, approve and implement measures aimed at ensuring equal opportunities regardless of gender, race, nationality, citizenship, language, origin, social status, religion, beliefs or opinions, age, sexual orientation, disability, ethnicity, religion; and (c) support, in accordance with the procedure established by law, the programs of religious communities and associations, public institutions, associations and charitable and support funds that promote the implementation of equal opportunities for persons of sex, race, nationality, citizenship, language, origin, social status, religion, belief, sexual orientation, disability, ethnicity, religion. Public authorities shall provide for measures to ensure equal opportunities in strategic planning documents. Municipal institutions shall provide for measures to ensure equal opportunities in the municipal strategic development plan and (or) the municipal strategic action plan. Violation of the obligations established in this Law shall be deemed a violation of equal opportunities or improper enforcement and non-compliance with prohibitions. A person who considers that his or her equal opportunities have been violated shall have the right to apply to the Equal Opportunities Ombudsman. Recourse to the Equal Opportunities Ombudsman does not limit one’s ability to defend one’s rights in court. The Equal Opportunities Ombudsman shall supervise the implementation of the Law on Equal Opportunities. Sexual harassment – this concept is understood as it is defined in the Law on Equal Opportunities for Women and Men of the Republic of Lithuania. In the courts or other competent institutions, when examining complaints, statements, requests, reports or lawsuits of natural persons, legal entities, other organizations and their divisions regarding discrimination based on gender, race, nationality, citizenship, language, origin, social status, faith, beliefs or views, age, sexual orientation, disability, ethnicity, religion, if the applicant indicates circumstances that allow to assume direct or indirect discrimination, harassment, sexual harassment, instructions to discriminate, persecution, hostile behavior or negative consequences due to the filing of a discrimination complaint, participation in a discrimination case or the presence of a discrimination report, it is presumed that direct whether there was a fact of indirect discrimination, harassment, sexual harassment, instruction to discriminate, harassment, hostile behavior or negative consequences for filing a discrimination complaint, participating in a discrimination case or reporting discrimination. The complained person must prove that the principle of equal opportunities has not been violated.
