Abstract

This Law regulates the sale of land, buildings and other immovable property, registration of rights to real estate, restrictions of these rights, legal facts established by law in the Real Estate Register, status of the Real Estate Register of the Republic of Lithuania, establishment, management, reorganization and liquidation of this register, and establishes the rights, duties and responsibilities of the manager of Real Estate Register. The Real Estate Register shall be established for the registration of immovable property and property rights, restrictions on these rights, legal facts established by law, and the provision of official information on the data stored in the register. Real estate, property rights thereto, restrictions on these rights, legal facts are considered registered when the relevant data is entered in the database of the Real Estate Register. The procedure for entering data into the database of the Real Estate Register shall be established by the regulations of the Real Estate Register. They are approved by the Government of the Republic of Lithuania. The manager of the Real Estate Register is the Ministry of Justice of the Republic of Lithuania, and the Government of the Republic of Lithuania shall appoint the manager of this register. The following immovables shall be registered in the Real Estate Register if they have been formed as separate objects of immovable property and have been assigned a unique number in accordance with the procedure established by the Law on the Real Estate Register: (a) land plots; (b) buildings; (c) apartments in apartment buildings; and (d) premises. The following rights in rem in immovable property shall be registered in the Real Estate Register: (a) ownership; (b) trust of the property; (c) management as an independent property right; (d) easement; (e) usufruct; (f) building right (surface area); (g) long-term lease (emphyteusis); (h) mortgage; and (i) pledge of a property right to an immovable.
