Abstract

This Law regulates the activities and management of Klaipeda state seaport. Klaipeda State Seaport is the property of the Republic of Lithuania. The founder of the port is the Government of the Republic of Lithuania. The boundaries of the territory of the port land and the territory shall be determined by the Government of the Republic of Lithuania on the proposal of the Ministry of Transport and Communications. Port land, water areas, hydrotechnical installations, quays, navigation routes and channels, navigation facilities and other infrastructure objects shall be state property. The Port Authority manages, uses and disposes of the property of the Port Authority in accordance with this and other laws of the Republic of Lithuania. The Port Authority has the right to lease harbor land for the needs of port activities, as well as operators functioning in the port area, even if their activities are not related to port activities. Port land, infrastructure and water areas shall not be privatized. Other state property objects located in the port may be privatized in accordance with the Law on the Privatization of State and Municipal Property, by agreement with the Ministry of Transport. The port is open to international shipping. For vessels with nuclear power plants and nuclear weapons, access to the port is prohibited. Enterprises located in the port who use or transport hazardous substances harmful to human health must ensure the safety of the working environment. The main functions of the Port Authority include: (a) preparation and realization of projects related to the development of port facilities and infrastructure; (b) control of compliance with laws, international maritime legislative documents and other legal acts of the Republic of Lithuania on shipping; (c) control of the environmental security of seaport, protection against pollution and mitigation of the consequences of pollution; and (d) construction, operation and development of port facilities and navigational equipment. Harbor master shall be responsible for the registration of vessels flying the flag of the Republic of Lithuania and issuance of registration documents thereto; piloting of vessels; and provision of navigational and hydrometeorological information. This Law is composed of IV Chapters divided into 44 Articles. Chapter I lays down general provisions. Chapter II regards state regulation of port operations. Chapter III regards economic and commercial activities in the port. Chapter IV lays down final provisions.
