Abstract

This Law regulates the environmental legislation in the Republic of Armeniaб the issues of organizing and implementing supervision over the implementation and enforcement of environmental legislation, specifications, categories, conditions, relations and environmental issues by establishing legal and economic basis of control. State environmental inspection shall perform control related to environment (pollution control), including atmospheric air (air quality and air pollution), water (freshwater pollution), land and soil (soil pollution), hazardous substances, wild fauna and flora (payment of environmental fees for use of wild fauna and wild flora species) with a view of ensuring safety of natural environment and protection of public health, and prevention of harmful impact on the natural environment. Objectives of environmental control shall be set as follows: (a) environmental protection and rational use of natural resources; (b) detection of environmental offences and enforcement of environmental legislation; (c) prevention of harmful effects on environment by business entities; and (d) prevention of environmental overuse. Environmental control must ensure public participation in the solution of environmental issues. Environmental control shall be performed in accordance with annual plans. This Law consists of 8 Chapters. Chapter 1 lays down general provisions. Chapter 2 regards environmental control. Chapter 3 establishes state environmental inspectorate system, environmental information system and establishes rights and duties of state environmental inspectorate. Chapter 4 establishes the particulars of environmental control by state environmental protection bodies. Chapter 5 regards implementation of environmental control. Chapter 6 establishes the rights and duties of entities subject to environmental control and inspection. Chapter 7 determines the system of state environmental inspection, state administration and local government in the sphere of environmental control. Chapter 8 establishes responsibility of environmental state inspection, state administration and local government in the sphere of environmental control. Article 7 establishes that the implementation of environmental control is provided by the Government of the Republic of Armenia and the inspection body in the field of environmental protection. Article 10 establishes that the environmental state inspection system of the Republic of Armenia is the totality of the structural and territorial divisions of the inspection body exercising control in the field of environmental protection. Territorial subdivisions are structures that perform supervisory functions on the administrative-territorial principle in relation to the requirements of environmental legislation. Article 17 establishes that the government of the Republic of Armenia defines the type, form, model and quantity of service weapons and ammunition assigned to the state environmental inspector in accordance with the law, as well as the list of positions entitled to carry weapons. Article 23 specifies that environmental control is carried out through inspections, observations and studies. Article 25 classifies special cases for the implementation of environmental inspections regarding the fulfillment of the requirements of the environmental legislation as follows: (a) emergency and emergency situations threatening the environment; (b) reports of state administration and local self-government bodies; (c) appeals and reports of citizens and organizations; and (d) the need to fulfill the obligations assumed by the international agreements of the Republic of Armenia.
