Abstract

This Law regulates veterinary and sanitary safety of foodstuffs, establishes basic principles and particulars of state control in the field of state management, and establishes rights, duties and liability of state supervisory bodies. It shall be applicable foodstuffs, including infant food, subject to veterinary and phytosanitary supervision, and also to pesticides and agrochemicals. Basic principles of state control of safety of foodstuffs shall be as follows: (a) protection of consumers’ health along the whole food chain (from production to consumption), preventing misleading and fraudulent practices; (b) transparency of food safety system; (c) traceability; (d) risk assessment and analysis; (e) responsibility of business entities; (f) precautionary principle; (g) good practices; (h) assessment and prognostication; and (i) intervention, prevention and prophylaxis. Access to information related to substances in direct contact with foodstuffs, safety control thereof shall be ensured at all manufacturing stages. Research and development of plans related to infectious diseases and toxicity through nutrition, and identification of infectious diseases common to animal and human beings shall be the authorized state bodies in the field of ensuring food safety. This Law consists of VII Chapters divided into 30 Articles. Chapter I lays down general provisions. Chapter II regards safety of foodstuffs, feedstuffs, veterinary and sanitary arrangements. Chapter III regards veterinary and sanitary control of commodities and safety certification. Chapter IV regards offences and regulates application of penalties. Chapter V establishes the rights and the duties of public officials in the field of food security. Chapter VI regards sampling and laboratory testing. Chapter VII lays down transitional provisions. Article 5.1 establishes that government policies in the fields of food and feed safety, veterinary medicine and phytosanitary are developed and implemented by the relevant ministry. Article 7 establishes that in order to protect human life and health, animal health and well-being, and plant health, state control in the fields of food safety, veterinary medicine and phytosanitary is carried out on the basis of risk analysis, except for cases defined by law. Risk analysis consists of three separate interrelated phases of risk assessment, risk management and risk communication. Article 13 establishes that the Government validates: (a) the procedure for issuing veterinary accompanying documents, safety certificates and certificates of compliance for import, export, transportation in the territory of the Republic of Armenia of products subject to veterinary control (supervision), food, substances in contact with food, and nutritional and biologically active additives, veterinary accompanying documents, safety certificates and compliance certificate forms , as well as the procedure for issuing other accompanying documents defined by legislation; (b) the procedure for recognition of the adequacy of sanitary, veterinary, phytosanitary measures and risk assessment; (c) the procedure for providing information to the state food safety inspection body by the State Revenue Committee subordinate to the government about the products subject to control (supervision) in the field of food, veterinary and phytosanitary imported into the Republic of Armenia; (d) the procedure for authorizing test laboratories conducting tests for the purpose of state control of food safety by tender; and (e) the procedure and forms of providing phytosanitary certificates for export, re-export.
