Abstract

This Law lays down rules for the merchant shipping in the seaports, the construction and establishment of seaports, and the management and regulation of activities in seaports and port facilities. Article 1 underlines that the provisions of this Law shall be in accordance with the Constitution, principles and norms of international law, international agreements to which Azerbaijan is a party, the Merchant Shipping Code, other laws and normative legal acts. The boundaries of the ports and the construction and establishment of seaports shall be determined and regulated by the relevant institution. All related information, including entry to and exit from ports, shall be registered to the Sea Port Registry. The principles of the state regulation of activities in seaports are listed in Article 8, including safety of human life and health, prevention of environmental pollution, state control over the import and export of fish products and processed products of aquatic resources, and conservation and rational use of water bodies. The customs, phytosanitary, veterinary, sanitary and radiation control shall be carried out at the ports in accordance with the relevant laws regulating these areas. Moreover, the operators of marine terminals, owners of port infrastructure facilities, ship captains, and other persons operating in the port shall take measures to prevent pollution of the port area against industrial and consumer wastes, oil pollution, and other substances which are dangerous and harmful to human health and the environment. Allocation of land for the construction of the port and the establishment of special protection zones around the port infrastructure facilities shall be carried out in accordance with the Land Code. Lands under the 20-50-meter coastal strip of the section of Caspian Sea belonging to Azerbaijan shall be provided to sea ports on the basis of the right of use and lease.
