Abstract

The Law consists of 7 Sections composed of 24 articles. Section 1 (arts. 1-3) lays down general provisions. Section 2 (arts. 4-8) regards state testing and state registration of pesticides, agrochemicals and technical equipment for the application thereof. Section 3 (art. 9-15) sets requirements for manufacturing, transport, trade, conservation, application, utilization, annihilation and sterilization of pesticides and agrochemicals. Section 4 (arts. 16-17) regards realization of state policy, state supervision and state control over the observance of the legislation on pesticides and agrochemicals. Section 5 (arts. 18-19) sets safety requirements for agricultural raw materials and foodstuffs. Section 6 (art. 20) establishes liability for the infringement of the legislation on pesticides and agrochemicals. Section 7 (arts. 21-21) lays down final provisions. The present Law regulates legal relations related to the state registration, manufacturing, purchase, transport, storage and application of pesticides and agrochemicals safe for human life and environment, establishes the rights and the duties of enterprises, institutions, organizations and citizens, and also plenary powers of state executive bodies and officials in the aforesaid sphere. The basic principles of the state policy in the sphere of pesticides and agrochemicals are: 1) priority of environmental protection in respect of economic efficiency of the utilization of pesticides and agrochemicals; 2) minimization of the application of pesticides at the expense of introduction of biological agriculture and other ecologically safe plant protection means (art. 3). National and imported pesticides and agrochemicals must comply with high biological efficiency, safety for human life and environment, state standards and sanitary norms (art. 4). Preparative forms of pesticides and agrochemicals shall be subject to state registration (art. 7). The application of pesticides and agrochemicals shall be carried out in conformity with regulations set for determined soil and climatic areas, with the consideration of agrochemical study of soil, the state of crops and forecasts for the development of pests and disease (art. 12). On the areas destined for growing crops destined for breastfeeding and dietetic foodstuffs pesticides and agrochemicals shall be applied according to special technologies ensuring compliance of breastfeeding and dietetic foodstuffs with sanitary and hygienic requirements set for such products (art. 13). Agricultural raw materials and foodstuffs of vegetable and animal origin in the process of manufacturing, storage and transport of which pesticides and agrochemicals were used must comply with sanitary and hygienic requirements confirmed by compliance certificate (art. 18). Safety for human health and the environment during manufacturing, transportation, storage, testing and use of pesticides and agrochemicals shall be ensured through compliance with the requirements established by state standards, sanitary norms, regulations and other normative documents. State registration of pesticides and agrochemicals shall be performed by the central executive body that implements state policy in the field of environmental protection, on a paid basis in the manner and amounts established by the Cabinet of Ministers of Ukraine, based on positive test results and research materials. Technical means of application of pesticides and agrochemicals, which are subject to the requirements and procedures of technical regulations on safety of machinery, are not subject to state testing, state registration and re-registration.
