This Law enters into force on January 1, 2023.
Abstract

This Law lays down rules for the safety of food and feed with the aims of protecting the health of people and animals as well as the rights of consumers; ensuring the adaptation of the legal framework on food and feed safety to international standards, norms and rules adopted by international organizations; increasing the competitiveness and export potential of local food and feed products; and creating favourable conditions for the development of entrepreneurship in the fields of primary production, production, processing, and the circulation and utilization of food and feed products. This Law applies to (I) food products that are initially produced, manufactured and processed in Azerbaijan and imported into Azerbaijan, as well as to the stages of initial production, production, processing, circulation, disposal and destruction of food products, (II) materials and products in contact with food products, as well as the stages of production and processing of materials and products in contact with food products, and (III) feed products that are primarily produced, produced and processed in Azerbaijan, imported into Azerbaijan, including feed products intended for animals that are obtained from food products and non-food products, primary production, production, processing, circulation, disposal of feed products and destruction stages. Basic principles of food safety are laid down in Chapter 3, including analysis of risk posed by a food product with scientific evidence, application of temporary measures to prevent possible danger to life and health, and the protection of consumer rights in the field of food safety. Furthermore, this Law sets out the general requirements for the safety of food and feed products, and more specifically the requirements for the safety of special purpose food products, biologically active food products, enriched/fortified food products, genetically modified organisms and feed products, bottled drinking water and water used in the processing of food products, primary production products, food and feed products imported into or exported or re-exported from Azerbaijan, materials and articles in contact with food products, as well as, the requirements for the safety of food and feed products during their production, processing, packaging, labelling, storage, transportation, sale and consumption. This Law underlines that the food entities involved in the production and processing of food and feed products are obliged to apply HACCP-based procedures in their facilities and have an internal food safety control system. Moreover, this Law sets out provisions on the registration, approval, certification, monitoring and traceability of food products in Chapter 6, state control measures in Chapter 7, and the rights and duties of food entities in Chapter 8.
