This Law regulates the quality of drinking water, with the objective of protecting people's health against the effects of any type of contamination of drinking water by ensuring its quality as clean and sanogenic water. Drinking water means water intended for human consumption, as follows: (a) any type of water in its natural state or after treatment, used for drinking, food preparation or other domestic purposes, regardless of its origin and regardless of whether it is provided by distribution network, from the tank or is distributed in bottles or other containers; (b) all types of water used as a source in the food industry for the manufacture, processing, preservation or sale of products or substances intended for human consumption, unless the Ministry of Health , the Ministry of Agriculture and Rural Development approves the use of water and it is demonstrated that the water used does not affect the quality and sanitation of the food product in its final form. The provisions of this Law do not apply to the following types of water: (a) natural mineral waters, recognized as such by the competent authorities, in accordance with the legislation in force; and (b) waters that have therapeutic properties, in the sense of the provisions established by law, regulations or administrative procedures relating to pharmaceutical products. Drinking water must be healthy and clean, meeting the following conditions: (a) be free of microorganisms, parasites or substances that, by number or concentration, can constitutes a potential danger to human health; (b) to meet the minimum requirements provided in tables 1A, 1B and 2 of Annex No. 1; and (c) to comply with the provisions of art. 5-8 and 12. The enforcement measures of this Law must not lead, directly or indirectly, to the deterioration of the real quality of drinking water, which affects human health, or to the increase in the degree of pollution of the waters used for obtaining potable water. Producers and distributors of drinking water ensure compliance with quality parameters and finance audit monitoring, as well as operational monitoring of potable water quality. The public health authorities of the county, respectively of the municipality of Bucharest, ensure the supervision and control of the monitoring of the quality of drinking water in order to verify that the water distributed to the consumer complies with the quality requirements and does not create risks for public health. Producers, distributors or users of drinking water, through public collective or individual systems, for bottling and for the food industry, will ensure the current, operational monitoring of drinking water, according to a program that must include at least the control of the efficiency of the treatment technology, especially of disinfection, and of the quality of drinking water produced, distributed and used. No substance or material used in installations of production, distribution, bottling, transport or storage of drinking water must not be found in higher concentrations than necessary for the purpose for which it was used and must not leave in the drinking water, directly or indirectly, compounds or impurities that diminish health protection.
