Abstract

This Law determines the legal, economic and organizational grounds for activities in the field of hunting and protection, restoration, breeding and sustainable use of hunting resources and regulates emerging relationships associated therewith. Hunting shall be intended a type of use of objects of the wild fauna species by shooting or catching, which includes the implementation of actions of searching, tracking and luring for the purpose of obtaining hunting resources (game). Hunting resources shall be intended wild fauna species that live in a state of natural freedom or semi-freedom on the territory of Turkmenistan, which, in accordance with this Law and other regulatory legal acts are used to implement activities in the field of hunting and protection of hunting resources, and management of hunting economy. This Law shall not be applicable to wild fauna species grown and kept in captivity. Legislation of Turkmenistan on hunting and protection of hunting resources is based on the following principles: (a) ensuring the rational use of hunting resources, preserving their biological diversity and maintaining a scientifically substantiated hunting economy; (b) the establishment of a legal regime for the territories in the use of hunting resources, taking into account their environmental, economic and other value; (c) management of hunting species with the use of gear and methods, consistent with the generally recognized principles of humanity and not allowing cruelty to animals; (d) participation of citizens and public associations in the preparation of regulatory legal acts in the field of hunting and protection of hunting resources, as well as in measures for the protection of hunting resources and their habitat in the manner established by the legislation of Turkmenistan; (e) transparency in the activities of state bodies, other legal and natural persons to provide the population with a complete, reliable and timely information in the field of hunting and protection of hunting resources; and (f) implementation of international cooperation in the field of hunting and protection of hunting resources. Legal entities and natural persons operating in the field of hunting and protection of hunting resources, their restoration, reproduction and sustainable use, are the subjects of relations in the field of hunting and protection of hunting resources. Bodies exercising state regulation in the field of hunting and protection of hunting resources are the Cabinet of Ministers of Turkmenistan, authorized body, local executive authorities and bodies of local government. In the case of legal entities and natural persons using hunting resources in the territory of Turkmenistan, they are based on the following basic principles: (a) compliance with the requirements of the legislation of Turkmenistan on hunting and protection of hunting resources; (b) preservation of the species and biological diversity of hunting species and other wild fauna species in a state of natural freedom; (c) protection of habitats, breeding grounds and migration routes of hunting resources and other places of their accumulation; and (d) rational use of hunting resources, taking into account the number of populations, economic and other expediency of their reproduction and preservation of the conditions for their restoration. In Turkmenistan are authorized the following types of management of hunting resources: (a) the use of hunting resources for recreational, commercial and subsistence hunting; (b) use of hunting resources with or without removal thereof from their natural habitat for economic, scientific, recreational, cultural and educational purposes, with or without exception; (c) use of hunting resources for the purpose of regulating the number of game; (d) use of hunting resources for the purpose of re-acclimatization and resettlement; and (e) use of hunting resources for the purpose of keeping and breeding objects of hunting in the state natural freedom or semi-free condition. Implementation of types of use of hunting resources with removal thereof from their habitat is allowed under permits issued authorized body. This Law contains X Chapters divided into 57 Articles. Chapter I lays down general provisions. Chapter II regards state regulation in the field of hunting and protection of hunting resources. Chapter III deals with participation of citizens and public associations in the field of hunting and protection of hunting resources, their tights and obligations. Chapter IV regards management of hunting resources and protection thereof, and hunting grounds. Chapter V regards hunting. Chapter VI regards hunting economy. Chapter VII regards enforcement of the national legislation on hunting and protection of hunting resources. Chapter VIII regards state registration of hunting resources, state hunting register and monitoring of hunting resources. Chapter IX regards economic regulation in the field of hunting and protection of hunting resources. Chapter X lays down final provisions.
