Abstract

This Law establishes legal and economic grounds for stockbreeding, and regulates relations between the state and stockowners. The scope of this Law shall be increase of animal production and improvement of the quality of animal products. The Act consists of eight Sections divided into 35 articles: (1) general provisions; (2) rights and duties of the owners of livestock, pastures and waterbodies; (3) breed improvement and animal reproduction; (4) animal feed; (5) scientific research; (6) financial issues; (7) liability and state supervision; and (8) conclusive provisions. Any legal or natural person can undertake stockbreeding activity on condition of meeting state requirements. Numbers of head of livestock population shall be limited only by the availability of animal feed, waterbodies and negative environmental impact caused by manorial runoff and animal waste. Stockbreeders shall have the right: (a) to choose freely animal breed according to the legislation currently in force; (b) to choose freely feeding methods; (c) to sell animals individually or through specialized organizations; (d) to take part in stockbreeding associations; and (e) to use public pastures fro grazing in accordance with contracts concluded with local self-government. Breed improvement and selection shall be carried out through scientific research and in accordance with the official data related to animal productivity and reproduction. Intellectual property rights and patents shall be applicable to animal production including young stock for breeding purposes, semen, embryos, incubation eggs, grain and incubation spawn. Herd books shall be kept by the state institution authorized by the Ministry of Agriculture and Food Industry. Pastures shall be allotted to stockowners for the period of five years. For the purposes of this law, the term animal is defined as any living organism belonging to one of the following species: cattle, pigs, horses, sheep, goats, fur-bearing animals, birds, rabbits, fish, bees and mulberry silkworms. Natural and legal persons who own, keep or manage animals shall be authorized to perform breeding and ranching animals for reproductive purposes. Owners of animals, pastures and waterbodies are entitled: (a) to choose freely for breeding species, breed, type, population, line, cross, hybrid of animals according to the List of animal breeds, types and crosses zoned in Moldova; and (b) to sell livestock and products of animal origin autonomously or through voluntary professional associations. Owners of livestock must comply with zooveterinary requirements related to keeping and breeding of livestock. The official control of animal achievements shall be performed by the National Food Safety Agency. Local public administration bodies develop agreements on the use of pastures and work plans for the maintenance, improvement and rational exploitation of public pastures. It is prohibited to use pastures in the first year after sowing or reseeding. Livestock owners have the right to use public pastures on the basis of a contract concluded with local public authorities.
