Abstract This Law establishes the fundamental principles of technical regulation arising in the process of establishment, execution of requirements related to processing, rendering services, and also defines legal bases of the functioning of the state system of technical regulation. Safety of produce and process shall be intended absence of unacceptable risks causing damage to human life, health, environment, including damage including to wild flora and wild fauna. Objects of technical regulation shall be products, except for veterinary drugs, and voluntary certification, except for veterinary, plant protection and plant quarantine. The main objectives of technical regulation are: (a) ensuring safety of products, processes and services for human life, health; (b) ensuring the safety of products, processes and services for human life, health and environment, including flora and fauna; and (b) prevention of actions misleading purchasers (consumers) regarding safety and quality of products and services, also by ensuring reliability of their conformity assessment, traceability of products and related processes. Manufacturer, importer and seller of products must declare safety of their products. This Law establishes responsibility of manufacturer, importer and (or) seller for release of products into circulation that do not comply with technical regulations and (or) standards. The use of conformity certificates in the territory of the Republic of Kazakhstan, when releasing in circulation products that are subject to mandatory confirmation of conformity, the information of which is absent in the register of technical regulation or unified registers of issued or accepted documents on conformity assessment of the Eurasian Economic Union, shall be prohibited. Technical regulations must contain: (a) an exhaustive list of products, processes, which are covered by requirements; (b) requirements applicable to the characteristics of products, processes, ensuring compliance with the establishes technical requirements. Technical regulation may contain the rules of sampling and testing of products, forms and schemes of conformity assessment and (or) requirements related to terminology, packaging, marking or labelling and rules of their application. The conformity mark is intended for marking products that have passed conformity assessment procedures. Voluntary confirmation of conformity is carried out in the form of voluntary certification.
