Abstract

This Law establishes requirements for the assignment of company names business legal entities of Turkmenistan, regulates relations arising in the field their legal protection. Trademark (service mark) shall be intended a designation that serves to individualize goods (work performed, services rendered) of an entrepreneurial legal entity. The rightыholder of the company name has the right to use the trademark (brand name). The use of a company name means an indication of the company name: (a) on the packaging of any product or in product information, labels, signs or any other information sources for the purpose of storing goods, offering it for sale, selling it, including its export sales; (b) during the offer and provision of any service; (c) in business documents or advertising; and (d) as an Internet address. Trademark (brand name) can also be used as an integral part of the trademark designation (service mark) or completely coincide with the indicated designations or be part of one or more registered designations belonging to the same owner. Legal protection is granted to a well-known company name in Turkmenistan if it makes it possible to distinguish one legal entity from others and does not mislead consumers regarding the activities of this person. Trademark (brand name) of a legal entity must contain an indication of the organizational and legal form of a legal entity and a proper name or a common name with a distinctive meaning. Legal protection of a company name in Turkmenistan arises on the basis of the state registration of a legal entity with an authorized body in the manner prescribed by law of Turkmenistan.
