Entry into force notes
This law enters into force at the time of entry into force of the Water Act.
Abstract

This Law establishes the third amendment of Law No. 54/2005 regulating the title ownership of water resources. Amendments deal with the ownership of water resources and lay down the requirements to be satisfied in order to use such resources. In addition, it regulates the lake and fluvial public domain which belongs to the state or to the autonomous regions. Without prejudice to the public domain of the State and the autonomous regions still belong: a) the public water domain of the lakes and ponds located entirely in municipal lands or municipal common areas; b) the public water domain of the municipal lakes and ponds entirely located on lands of the municipality or in vacant lots. Amended article also establish areas threatened by possible floods, expropriation and other type of public land ownership dispossessed from plots, beds or public waters resources.
