Abstract This Law establishes the legal, economic and social basis for the cultivation, industrial processing, import, manufacturing, storage and trade of tobacco products. Its purpose shall be to protect state economic interests in the agrarian sector and the tobacco industry, including the import and trade of tobacco products and the manufacture of fermented and non-fermented tobacco. The Act consists of six sections: (1) general provisions; (2) processing and post-harvest treatment of tobacco; (3) industrial processing of tobacco and manufacture of tobacco products; (4) use restrictions of tobacco; (5) state supervision of the tobacco industry; and (6) transitional and final provisions. Supply chain shall be intended the system of activities involving the growing of tobacco, excluding small-scale tobacco growers, farmers and manufacturers traditionally engaged in such activities. Tobacco processing shall include cultivation and post-harvest treatment in conformity with technological requirements, normative and technical documentation and national standards. Post-harvest treatment shall include the drying, sizing and packaging of tobacco. Economic entities that cultivate and treat harvested tobacco shall: (a) maintain and improve soil fertility; (b) apply eco-friendly technologies and processes; and (c) apply authorized phytosanitary measures.
