Abstract The notion “selection achievement” is applicable to plant variety and animal species (art. 1). The State patent institution shall carry out state policy in the sphere of legal protection of selection achievements, receive and examine the applications for obtaining patents and certificates of selection achievements, carry out formal expertise thereof, keep the State register of selection achievements, publish official data on the submitted applications and registered selection achievements protected in the Republic of Uzbekistan, issue regulations and elucidation on the application thereof and of the present Law (art. 3). Selectionist is a natural person by which creative activity plant variety or animal species has been discovered or selected (art. 4). Selection achievement shall be protected by Law if it meets the following requirements: novelty, distinguishability, uniformity and stability (art. 7). The right to selection achievement shall be identified by patent or certificate that shall be issued for selection achievement meeting the criteria of patentability and pertaining to botanical and zoological genus and species protected in the Republic of Uzbekistan (art. 13).
