This Law defines the legal and organizational principles of quality schemes for agricultural commodities and foodstuffs, particulars of preparation for registration, registration, use and protection of geographical indications for agricultural products (agricultural goods) and food products, implementation of control over such geographical indications, as well as legal principles protection of traditional guaranteed features, including preparation for registration, registration, use, protection and control. This Law shall be applicable to agricultural commodities and foodstuffs destined for human consumption. Authorized state body in accordance with this Law: (a) develops and adopts regulatory legal acts within the scope of powers specified by this Law; (b) forms an expert commission and ensures its functioning; (c) ensures approval of the product specification and changes thereto; (d) organizes the acceptance of applications for traditional guaranteed features, their research, state registration, publication of information about traditional guaranteed features; (e) ensures control of special qualities or other characteristics of goods for which geographical indications and traditional guaranteed features are used; (f) ensures the entry of certification bodies in the Register of certification bodies, as well as maintenance of this register; (g) ensures the determination of the boundaries of geographical locations with which such special qualities or other characteristics are associated, and of the producers of the specified commodities within the relevant geographical locations; (h) ensures formation and maintenance of the list of users and the Register of traditional guaranteed features; (i) applies to the national accreditation body of Ukraine regarding established facts of violations by the certification body with the aim of taking appropriate measures by this body, provided for by the legislation of Ukraine in the field of accreditation; (j) interacts with the National Intellectual Property Authority regarding the exercise of powers in accordance with this Law; (k) approves requirements for the national symbol and rules for its use; and (l) exercises other powers provided for by this Law. For the purposes of this Law, as a quality scheme for the name of the place of origin of the commodities, a name that identifies a commodity that originates from a certain geographical place, such as a part of a country, a settlement, a locality, etc., or, in exceptional cases, a country, is distinguished, given legal protection and used. The name identifying the commodities is recognized as the name of the place of origin of the commodities, if the commodities originating from this geographical place have special qualities or properties that are exclusively or mainly due to the specific geographical environment with its inherent natural and human factors, provided that all stages of its production and/or processing and/or preparation are carried out in a defined geographical area. The name of the geographical place of production is recognized as the name of the place of origin of the commodities, if the raw materials for the production of the commodities come from this geographical place or from another geographical place, provided that another geographical place of production (extraction) of the raw materials is determined, there are special conditions of production (extraction) of such raw materials. The name is recognized as a geographical indication or the name of the place of origin of the commodities, if the criteria for not recognizing the name of the goods as a geographical indication do not apply to it. This Law does not grant legal protection to a geographical indication related to a geographical place in a foreign state, if the rights to such an indication or another indication, which in its content corresponds to the concept of a geographical indication, are not protected in the relevant foreign state. The traditional guaranteed feature as a quality scheme is applicable to: (a) preservation of traditional methods of production and recipes of agricultural commodities or foodstuffs by assisting producers of traditional products in their circulation on the market and informing consumers about the features of their traditional recipes and properties that form added value; (b) ensuring proper protection of the names of such traditional products by registering them as traditional guaranteed features; and (c) supporting manufacturers of traditional products in promoting their trade and informing consumers about the characteristics and features of such a product. The rights arising from the registration of a geographical indication or a traditional guaranteed feature are valid from the date of their registration. This Law contains X Sections divided into 51 Articles. Section I lays down general provisions. Section II preparation for registration and registration of geographical indications. Section III traditional guaranteed features. Section IV particular indicators of quality. Section V regards the use of registered geographical indications and guaranteed traditional features. Section VI establishes protection of rights and the role of associations. Section VII lists exceptions for certain cases of prior application. Section VIII establishes control measures regarding the application of quality schemes and liability for violations. Section IX establishes responsibility for breach of law. Section X lays down final and transitional provisions.
