Abstract

The Law consists of 6 Sections composed of 26 articles dealing with the following matters: 1) general provisions (sect. 1, arts. 1-5); 2) application of plant quarantine (sect. 2, arts. 6-13); 3) the state plant quarantine service (sect. 3, arts. 14-18); 4) dispute settlement (sect. 4, arts. 19-22); 5) liability (sect. 5, arts. 23 and 24); 6) international cooperation (sect. 6, arts. 25 and 26). The Law establishes the basis for the legal regulation in the sphere of plant quarantine and has as its purpose the protection of legal rights and legitimate interests of natural and legal persons. The purpose of this Law shall be to ensure the protection of plants and planting material against pests and diseases on the national territory (art. 1). The Government shall have the following plenary powers in the sphere of plant quarantine: 1) to elaborate and to carry out the common policy; 2) to carry out the state quarantine phytosanitary inspection; 3) to impose and to revoke quarantine; 4) to set the modalities for import and export of materials subject to quarantine inspection; 5) to carry out phytosanitary certification (art. 4). The state quarantine inspection of plants shall be carried out by the authorized state institution nominated by the Government. The aforesaid institution shall have the authority to carry out the state quarantine phytosanitary inspection on the national territory (art. 5). In case of the exposure of contamination (pest infestation) of the materials subject to quarantine inspection the authorized state institution must impose quarantine phytosanitary zone and quarantine phytosanitary regime and give notice thereof to the executive body authorized to impose quarantine (art. 6). Import of the infected materials and also materials subject to quarantine inspection that were imported in violation of the norms and instructions regulating plant quarantine shall be prohibited (art. 8). The materials subject to quarantine inspection that are infested with pests must pass compulsory disinfestations (art. 9). For the purpose of the prevention of the propagation of pests and diseases the materials subject to quarantine inspection can be seized, destroyed or returned by order of the officials of the authorized state institution (art. 12). Natural and legal persons shall be liable to the compensation of damages caused by the infringement of the legislation on plant quarantine (art. 23).
