Abstract

The present Law determines general legal, organizational and financial grounds of veterinary medicine in Ukraine. It sets forth requirements relating to veterinary-sanitary quality and safety of products of animal origin and products of vegetable origin sold at markets, environmental protection and authorities of state bodies, rights and obligations of legal entities and natural persons in the field of ensuring veterinary and epizootic welfare, animal quarantine, conduction of state veterinary-sanitary control and supervision. State administration in the field of veterinary medicine shall be carried out by the Cabinet of Ministers of Ukraine, specifically authorized central body of executive power on agricultural policy issues, the State Department of Veterinary Medicine, its territorial bodies and regional services of the state veterinary-sanitary control and supervision at the state border and transport. Authorities of public administration bodies in the field of veterinary medicine are determined in Section 2 of the Law. According to this Law doctors of state institutions of veterinary medicine carry out state veterinary-sanitary control. Rights and obligations of persons carrying out such control are specified in the Article 11 of the Law. Officials entitled to carry out state veterinary-sanitary control and supervision are determined in Article 12 of the Law, and their rights and obligations - in Article 13 of the Law. This Law outlines mechanisms of state veterinary-sanitary control and supervision over safety and quality of veterinary drugs, preparations, substances, and formulations for veterinary medicine (Art. 17); regards state veterinary and sanitary supervision at state border of Ukraine and inspection of transport means (Art. 18). In case of establishment of the quarantine of animals, the head of the State Emergency Antiepizootic Commission under the Cabinet of Ministers of Ukraine or heads of relevant local state emergency antiepizootic commissions can make an immediate performance of special professional and other tasks in accordance with veterinary and sanitary measures by all or individually licensed doctors of veterinary medicine, state veterinarians, official veterinarians and others specialists in veterinary medicine (Art. 45). In case of suspicion of detecting an illness, that must be reported, but is not particularly hazardous and requires application of quarantine (quarantine restrictions), appropriate Chief State Veterinary Inspector issues an order on introduction of quarantine of animals: (a) immediately after confirmation of the outbreak of quarantine disease; and (b) if within 24 hours after receiving information about suspicion of an outbreak of quarantine disease it was not eliminated (Art. 48). This Law consists of 17 Sections divided into 109 Articles. Section 1 lays down general provisions. Section 2 establishes state regulation in the field of veterinary medicine. Section 3 regards state veterinary and sanitary control and supervision. Section 4 establishes the principles of elaboration, validation and implementation of veterinary and sanitary arrangements. Section 5 regards protection of animal health. Section 6 regards circulation (trade) of livestock and reproductive material. Section 7 regards State Emergency Antiepizootic Commission and animal quarantine. Section 8 establishes regulation of manufacturing and circulation of non-edible products of animal origin. Section 9 regards scientific substantiation of veterinary medicine, public pharmacological commission of veterinary medicine, state and authorized laboratories. Section 10 regards regulation of manufacturing and circulation of veterinary preparations, substances and veterinary drugs. Section 11 establishes requirements for manufacturing of animal feed additives, premixes and animal feedstuffs. Section 12 establishes requirements for international trade. Section 13 regards financing, material and technical support. Section 14 regards veterinary practice, training and status of veterinary medicine staff and supply of information to State Veterinary Medicine Service. Section 15 establishes liability for the infringement of legislation in the field of veterinary medicine. Section 16 regards international cooperation. Section 17 lays down final provisions.
