Abstract

This Law defines the legal, organizational and financial basis for support by the Government of the Republic of Tajikistan, local executive bodies of state power of the branches of the agro-industrial complex. The purpose of this Law is to develop the agro-industrial complex, to provide the domestic market with food and raw materials of the processing industry, as well as to increase the export potential of the Republic of Tajikistan. Subsidy (financial support) shall be intended specific and targeted funds aimed at supporting certain sectors of the agro-industrial complex. Users of the subsidy (financial support) shall be natural persons and legal entities, regardless of the forms of ownership, which carry out their activities in the Republic of Tajikistan. Agro-industrial complex is an aggregate of branches of the economy, which includes production, harvesting, storage, transportation, processing and trade of agricultural commodities, including fish products, food industry, other related fields of activity, including providing them with modern technology with technological equipment, informational and other resources, veterinary and sanitary security, and scientific support and training of personnel. Agricultural commodities shall include products of plant growing, livestock breeding, poultry and beekeeping, including products obtained through primary processing. State support to the branches of the agro-industrial complex shall be granted to natural persons and legal entities, regardless of ownership, in the following forms: (a) distribution of subsidies (financial support) from the state budget; and (b) attracting foreign investments and grants for the development of branches of agro-industrial complex. The Government of the Republic of Tajikistan annually, when drafting the Law of the Republic Tajikistan on the state budget for the next fiscal year, taking into account financial opportunity, determines the amount and procedure of allocation of subsidies (financial support) for specific purposes. Attraction of foreign investments and grants for the development of branches of agro-industrial complex is the basis of state support of agro-industrial sector and is carried out in accordance with the procedure established by the Government of the Republic Tajikistan. Subsidy (financial support) depending on the activity of physical and legal persons, irrespective of the forms of ownership, shall be distributed between the following branches of agro-industrial complex: (a) elite and primary seed production, production of seeds of the first and second reproductions, creation of operating fund of agricultural crops; (b) increase of fertility of agricultural land; (c) improvement of the land reclamation state of irrigated arable land; (d) development of new lands and involvement in agricultural production of abandoned land; (e) an increase in the yield and production of cotton, potatoes, vegetables, melons, cereals, legumes and tobacco and the fight against diseases thereof; (f) establishing of orchards and vineyards, the construction of greenhouses for seedlings of fruit crops; (g) purchase and breeding of pedigree animals, birds and fish; (h) development of the veterinary industry and carrying out of anti-epizootic measures; (i) development of the beekeeping industry; (j) purchase of silkworm eggs (cocoons) and the fight against harmful diseases of Spanish broom (Spartium junceum); (k) development and introduction of achievements of science and technology, further creation and strengthening of the national gene pool of agricultural crops, animals, birds and fish, as well as purchase of modern equipment and tools, chemical and biological products for research institutes of branches of agro-industrial complex; and (l) organization of new production, purchase and creation of stock of pesticides and minerals fertilizers.
