Law No. 2393-IX amending some laws of Ukraine regarding the improvement of the mechanism of regulation of emissions of polluting substances into the atmospheric air.

This Law enters into force the day after the date of its official publication.
Abstract

Article 11 of the Law No.2707-XII on protection of atmospheric air shall be amended to add the following wording: “Emissions of polluting substances into atmospheric air by stationary sources may be carried out after obtaining a permit for emissions issued to a business entity, the object of which belongs to the second or third group, by the regional bodies of the executive power in matters of environmental protection, or through centers for the provision of administrative services in agreement with the territorial body of the central body of executive power, which implements state policy in the field of sanitary and epidemic welfare of the population. Emissions of polluting substances into the atmospheric air by stationary sources may be carried out on the basis of an emission permit issued to a business entity whose facility belongs to the first group, a business entity whose facility is located in the territory of the exclusion zone, the zone of unconditional mandatory) resettlement of the territory that was radioactively contaminated as a result of the Chernobyl disaster, by the central executive body implementing state policy in the field of environmental protection, or through centers for the provision of administrative services in agreement with the central executive body implementing state policy in the sphere sanitary and epidemic well-being of the population"; "The validity period of the emissions permit issued to the business entity whose object belongs to the first group, to the business entity whose object is located in the territory of the exclusion zone, the zone of unconditional (compulsory) resettlement of the territory that has undergone radioactive pollution as a result of the Chernobyl disaster, - seven years, the object of which belongs to the second group, - ten years, the object of which belongs to the third group, - unlimited.” Article 14 of the Law No. 1644-VII “On sanctions” shall be amended to add the following wording: “Emissions of polluting substances, for which the relevant norms of environmental safety of atmospheric air have not been established, are allowed in exceptional cases only with a permit issued to an economic entity whose object belongs to the first group, an economic entity whose object is located on the territory exclusion zones, zones of unconditional (mandatory) resettlement of the territory that was radioactively contaminated as a result of the Chernobyl disaster, by the central executive body implementing the state policy in the field of environmental protection, or through centers for the provision of administrative services in agreement with the central executive body , which implements state policy in the field of sanitary and epidemic well-being of the population, and for the second or third group, - by regional state administrations, competent in the field of environmental protection, or through centers of provision of administrative services in agreement with the territorial body of the central body of executive power, which implements state policy in the field of sanitary and epidemic welfare of the population".
