Abstract

The scope of this Law shall to provide state support to agricultural producers in providing high-quality certified seed material for agricultural crops and to create favorable conditions for seed farms of the Kyrgyz Republic for the production and trade of high-quality certified varieties of seeds of priority agricultural crops through the introduction of the state subsidy mechanism. This Law regulates the legal framework for the introduction of the state subsidy mechanism in seed production in order to ensure the sustainable development of relations between public authorities and local governments, seed farms and agricultural producers. This Law applies to the production and trade of certified varieties and hybrids of priority agricultural crops included in the State Register of Plant Varieties and Hybrids Allowed for Use in the Kyrgyz Republic. The provisions of this Law shall apply throughout the territory of the Kyrgyz Republic to all seed farms having an official status for production, trade and use of seeds of one or more priority agricultural crops destined for sowing. This Law is based on the following principles: (a) equal access to state subsidies for seed farms producing seeds of priority agricultural crops and selling them to agricultural producers; (b) compliance of the quality of seeds produced with the standards adopted in the Kyrgyz Republic; (c) environmental and phytosanitary safety of seed farms; (d) interaction with research institutions and organizations engaged in activities in the field of breeding and seed production; (e) development of competitiveness of agricultural commodities; and (f) import substitution and export orientation. The main direction of introduction of the state subsidy mechanism in seed production shall be allocation of budget funds for reimbursement to seed farms of the Kyrgyz Republic of 30% of the cost of production of trade of seeds of super-elite, elite, first and second reproduction of varieties and hybrids of the first generation of priority crops. State subsidies shall be paid to seed farms, which have fully met all their obligations on the supply of certified seeds of priority agricultural crops to agricultural producers.
