Entry into force notes
The present Law shall enter into force six months after its official publication except for Article 14 that enters into force from the date of its official publication.
Abstract

This Law is aimed at improving legal, organizational and economic foundations of state regulation in the field of quality of alimentary raw materials and foodstuffs and their safety for human life and health. This Law does not apply to natural persons that are not individual entrepreneurs and perform production and (or) the turnover of alimentary raw materials and foodstuffs. Safety of alimentary raw materials and foodstuffs shall be intended as absence of risks associated with harmful effects on human beings and future generations when used in recommended conditions. Food quality shall be intended a set of properties and characteristics of foodstuffs that determine their ability to satisfy physiological human needs for food under normal conditions of use, the totality of these properties and characteristics that are mandatory for compliance with technical regulatory legal acts, and (or) documents of the manufacturer, and (or) civil legal agreements concluded by the manufacturer and/or requirements for compliance with which the manufacturer voluntarily declared in a different way, and in respect of biologically active food additives - also a set of properties that provide the effectiveness of biologically active food additives provided they are used for the purposes for which they are intended. Quality of alimentary raw materials shall be intended a set of properties and characteristics of alimentary raw materials that determine their suitability for use in for the purposes for which they are intended, the conformity of these properties and characteristics for compliance with mandatory requirements of technical regulatory legal acts, and (or) documents of the manufacturer, and (or) civil law contracts concluded by the manufacturer, and (or) requirements for compliance with which the manufacturer voluntarily declared in a different way. The basic principles of state policy in the field of quality assurance and the safety of alimentary raw materials and foodstuffs shall be as follows: (a) equal rights of legal entities, individual entrepreneurs in the field of ensuring quality and safety of alimentary raw materials and foodstuffs; (b) presumption of good manufacturing practice (GMP) of legal entities, individual entrepreneurs engaged in the manufacturing and (or) turnover of alimentary raw materials and foodstuffs; (c) inadmissibility of unlawful interference by government bodies and other state organizations in the activities of legal entities, individual entrepreneurs engaged in the manufacturing and (or) turnover of alimentary raw materials and foodstuffs; and (d) responsibility of state bodies and other state organizations for ensuring quality and safety of alimentary raw materials and foodstuffs. Quality and safety of alimentary raw materials and foodstuffs shall be ensured by: (a) technical regulation and standardization in relation to alimentary raw materials and foodstuffs; (b) application of sanitary and epidemiological requirements for alimentary raw materials and foodstuffs, manufacturing and circulation thereof; (c) veterinary and sanitary examination of unprocessed alimentary raw materials of animal origin; (d) state registration of foodstuffs and products contacting with alimentary raw materials and foodstuffs, certain technical regulations of the Customs Union, the Eurasian Economic Union and other international legal acts constituting the legislation of the Eurasian economic union; (e) state sanitary and hygienic expertise of alimentary raw materials and foodstuffs; (f) licensing of certain types of manufacturing and/or circulation of alimentary raw materials and foodstuffs; (g) certification or declaration of conformity of alimentary raw materials and foodstuffs in accordance with legislation, technical regulations of the Customs Union, the Eurasian Economic Union and other international legal acts constituting the legislation of the Eurasian Economic Union; (h) in cases established by legislative acts, technical regulations of the Customs Union, the Eurasian Economic Union and other international legal acts constituting the legislation of the Eurasian Economic Union, testing of alimentary raw materials and foodstuffs in test laboratories (centers) on safety indicators, as well as on declared manufacturer quality indicators; (i) observance by legal entities and individual entrepreneurs engaged in the manufacturing and (or) trade of alimentary raw materials and foodstuffs of the requirements for food processing, manufacturing, trade, storage, transportation, use, destruction, disposal, import into the Republic of Belarus, exportation from the Republic of Belarus of alimentary raw materials and foodstuffs in accordance with the modalities established by legislative acts, international treaties of the Republic of Belarus, as well as technical regulations of the Customs Union, the Eurasian Economic Union and other international legal acts constituting the legislation of the Eurasian Economic Union; (j) performance by legal entities and individual entrepreneurs, engaged in the production and (or) trade of alimentary raw materials and foodstuffs food quality and food safety control, including laboratory testing, of manufacturing, transportation, storage and trading conditions; (k) taking measures to prevent and suppress violations of legislation in the field of quality and safety of alimentary raw materials and foodstuffs products, including legal proceedings against infringers; and (l) taking other measures to ensure quality and safety of alimentary raw materials and foodstuffs.
