This Law enters into force on 1 April 2020.
Abstract

This Law establishes the grounds for licensing of some activities and also regulates relations connected with implementation thereof. Provisions of this Law shall not apply to: (a) relations arising from the use of intellectual property objects; (b) oil works carried out in accordance with the Law of Turkmenistan "On Hydrocarbon Resources"; (c) specialized activities related to ensuring law and order, defense and security of the state; and (d) activities that are not entrepreneurial activity. The main principles of licensing are the following: (a) implementation of the State policy in the area of licensing; (b) ensuring the transparency of licensing and the issuance of licenses on equal terms and conditions to natural and legal persons who meet the established licensing requirements and conditions; (c) ensuring the legality of licensing; (d) establishment by the present Act of a single list of licensed activities and a uniform licensing procedure in the territory of Turkmenistan; and (e) establishment of norms of liability of natural and legal persons for violations of legislation of Turkmenistan on licensing of some activities.Article 2 establishes that this Law shall not be applicable to intellectual property, oil extraction processes, law enforcement, defence and security. Article 3 lays down basic principles of licensing: (a) realization of state policy; (b) transparency; (c) unified list of activities subject to licensing and unified rules of licensing; and (d) liability for infringement of legislation on licensing. Article 8 establishes competence of licensing authority. Article 9 establishes that licence shall be issued separately for each type of activity and the licence shall be valid on the whole territory of Turkmenistan. Article 10 establishes that licence for professional services shall be open-ended while licence for entrepreneurial activity shall be issued for a determined period of time but no less than for three years. Article 20 specifies activities subject to licensing, inter alia: (a) veterinary activity; (b) pedigree stockbreeding; (c) seed growing; (d) industrial fisheries and catch of aquatic animals; (e) management of natural resources and environmental protection; (f) processing and trade of foodstuffs and animal feed; (g) electric energy; and (h) geodetic and cartographic activity.
