Abstract Article 102 (1) of Land Code (No. 2768-III of 2001) shall be amended to add the following wording: “A person who uses a land plot with the right of emphyteussis for the cultivation of perennial plantations (fruit, berry, nut-bearing, grapes) and properly fulfills his obligations under the contract, after the expiration of the term of the contract, has a priority right over other persons to conclude an emphyteussis contract with respect to this land areas for growing perennial crops (fruit, berry, nut, grape) for a new term. This right is exercised according to the rules established by Article 33 of the Law of Ukraine "On Land Lease".” Article 32 of Law No.161-XIV “On lease of land” shall be amended to add the following wording: "In case of termination of the land lease contract at the initiative of the lessor (except for cases of contract termination due to improper performance by the lessee of his duties) the tenant has the right to reimbursement of the costs of improvements of the leased land plot, carried out with the consent of the lessor, and losses, caused by the termination of the contract".
