This Law enters into force on the date of its official publication.
Abstract

This Law regulates conservation, management and exploitation of living aquatic resources, aquaculture activity, and processing and marketing of fish and aquaculture products, when these activities are carried out: (a) on the Romanian territory; (b) in the maritime waters by ships flying the Romanian flag or ships flying the flag of other states; and (c) in the national waters of other states or in high seas by ships flying the Romanian flag. This Law establishes measures concerning: (a) the organization and administration of the fishing sector; (b) conservation and exploitation of living aquatic resources; (c) structural policy and fishing fleet capacity management; (d) aquaculture, (e) marketing of fish products; (f) scientific research in the field of fisheries; (g) control and compliance with regulations; (h) international relations; (i) liability. It represents the general regulatory framework, on the basis on which secondary legislation is issued for the fisheries sector. The objectives of this Law shall be as follows: (a) sustainable management of living aquatic resources in natural fish basins and the adoption of the necessary measures to preserve and reproduce them and preserve natural ecosystems; (b) protection of living aquatic resources in protected areas; (c) development of aquaculture; (d) improvement of conditions for the performance of fishing and aquaculture; (e) stimulating fishing association; (f) stimulating consumption of fish products; (g) stimulating responsible trade, which contributes to the conservation of fish resources; (h) improving the quality of fish products, market transparency and consumer information; (i) stimulating scientific research in the field fishing; (j) protection of living aquatic resources, through the activities carried out in the perimeter of the Danube Delta Biosphere Reserve, which are subject to specific regulations. National Agency for Fisheries and Aquaculture shall be appointed authorized state institution in the field of conservation and management of living aquatic resources and aquaculture. This Law contains XIII Sections divided into 86 Articles. Section I regards reorganization of fishery sector. Section II regards fishing in natural water basins and fishing authorization. Section III regards fishing rights and fishing license. Section IV defines fishing. Section V regards protection of fish stocks. Section VI regards aquaculture. Section VII regards fishing inspection. Section VIII regards organization of fish products market. Section IX regards structural policy and management of fishing capacity. Section X establishes measures for protection and management of living aquatic resources. Section XI regards scientific research. Section XII establishes liability and penalties. Section XIII lays down final provisions.
