The Law enters into force from the date of its official publication.
Abstract

The present Law regulates relations in the field of protection of the atmospheric air with the scope of ensuring its purity and rational use, prevention and reduction of hazardous chemical, physical, biological and other hazardous impact upon atmosphere, and also law enforcement in the afore-mentioned field. The main directions of public activity in the field of protection of the atmospheric air are: 1) prevention, reduction and cessation of impact of hazardous chemical, biological, radiation, physical and other substances, and also fluorocarbons on the atmospheric air; 2) rational use of the atmospheric air for industrial needs and carrying out arrangements for the renewal of its natural composition; 3) inadmissibility of soil pollution, water pollution and pollution of other natural objects in the process of putting into effect arrangements for protection of the atmospheric air; 4) complex environmental impact assessment of the emissions into the atmosphere(art. 2). The Turkmenistan nationals have the right to: 1) have access to reliable information concerning the state of environmental pollution; 2) compensation from legal persons for the damage caused their health and personal farms by emergency and a volley emissions of the hazardous substances into the atmosphere; 3) take part in the arrangements by state institutions regarding protection of the atmospheric air (art. 9). Emission standards are common on the whole territory of Turkmenistan (art. 10). Legal and physical person manufacturing commodities containing substances depleting ozone layer shall register them and use technology preventing the depletion of ozone layer (art. 25). Legal and physical person shall undertake measures aimed at energy saving, reduction of the emissions of fluorocarbons having negative impact and causing climate change and use renewable sources of energy (art. 26). The Ministry of Nature Management and Environmental Protection shall carry out monitoring and prognostication of climate change and also of ozone layer (art. 30). Legal persons shall pay environmental fees for emissions of pollutants in the atmosphere (art. 35). The Law consists of 12 Sections composed of 38 articles.
