Abstract

The present Law establishes legal, organizational and financial basis for carrying out state expertise of land use documentation and the modalities of tits carrying out. State expertise of land use documentation is activity aimed at valuation, control and analysis of the objects of expertise for the purpose of the compliance thereof with the legislative requirements, standards, norms and instructions, and also elaboration of substantiated conclusions for decision-making as regards the objects of the expertise. The main targets of state expertise are: 1) organization of complex, scientifically substantiated valuation of the objects of expertise; 2) compliance of the objects of expertise with the legislative requirements, standards, norms and instructions; 3) elaboration of the objective and substantiated requirements of the state expertise. The objects of the state expertise are land use documentation and land valuation documentation that is established by the legislation, and also materials and documentation of state land cadastre. The following are subject to obligatory state examination: (a) land use planning schemes and feasibility studies for the use and protection of lands of administrative-territorial units; (b) land survey projects to establish (change) the boundaries of administrative-territorial units; (c) land survey projects for the organization and establishment of boundaries of nature reserves and other environmental purposes, health, recreational, historical and cultural, forestry, water fund land and water protection zones, restrictions on land use and their regime-forming objects; (d) land survey projects for the allocation of land plots of particularly valuable lands, forest land, as well as land of water fund, nature protection, health, recreational and historical and cultural purposes; (e) land survey projects for landscaping of settlements; (f) land survey projects for land privatization of state and communal agricultural enterprises, institutions and organizations; (g) technical documentation on land survey for land inventory in case of formation of land plots at the expense of particularly valuable land, forest land, as well as land of water fund, nature protection, health, recreational and historical and cultural heritage; and (h) technical documentation on soil quality assessment, normative monetary valuation of land plots. The Law consists of 9 Sections that contain 42 articles. Section 1 (arts. 1-7) lays down general provisions. Section 2 (arts. 8-15) specifies the forms and the types of state expertise. Section 3 (arts. 16-22) regards regulation in the sphere of state expertise. Section 4 (arts. 23-26) determines the status of expert of state expertise. Section 5(arts. 27-30) determines the rights and the duties of the customers of state expertise and projectors of the objects of state expertise. Section 6 (arts.31-39) establishes the modalities of carrying out state expertise. Section 7 (art. 40) establishes liability for the infringement of the legislation in the sphere of state expertise. Section 8 (arts. 41 and 42) regards international agreements in the sphere of state expertise. Section 9 lays down final provisions.
