Entry into force notes
This Law enters into force on the day following its publication, and shall be put into effect three months after the date of entry into force of this Law.
Abstract

Article 42 shall be amended to add the following wording: “Water users in Ukraine can be enterprises, institutions, organizations and citizens of Ukraine, as well as foreigners and stateless persons, foreign legal entities. Water users can be primary and secondary. Primary water users are those who have their own water intake facilities and appropriate equipment for water intake, and also receive water from irrigation and drainage system channels, reservoirs, ponds, water management systems, canals and aqueducts (aqueducts) of inter-basin and intra-basin redistribution of water resources. The withdrawal and use of water by primary water users from the channels of irrigation and drainage systems, reservoirs, ponds, water management systems, channels and aqueducts (aqueducts) of inter-basin and intra-basin redistribution of water resources are carried out on a paid basis on the basis of a contract with enterprises, institutions and organizations that provide redistribution ( transfer) of water resources, including in low-water regions, and in the presence of a permit for special water use. The conclusion of the contract is mandatory. The list of enterprises, institutions and organizations that ensure the redistribution (transfer) of water resources, including in low-water regions, is approved by the Cabinet of Ministers of Ukraine. Secondary water users (subscribers) are those who do not have their own water intake facilities, receive water from the water intake facilities of primary water users and discharge wastewater into the systems of such primary water users on the basis of a water supply (water supply) and/or drainage agreement without obtaining a permit for special water use. Secondary water users discharge wastewater into water bodies on the basis of permits for special water use."
