Abstract This Law, consisting of 26 articles and two Annexes, establishes standards and guidelines for the control of air quality within the State of Pernambuco, prescribing that any form of emission of atmospheric pollutants above the limits stipulated in the legislation is prohibited. It establishes as a principle that potentially polluting activities released in the air must adopt the use of technologies, inputs and energy sources that avoid the generation of atmospheric pollutants, minimizing emissions compared with conventional processes. The release into the atmosphere of any type and form of matter or energy that may cause air pollution, under the terms of the law, is prohibited. Open burning of solid, liquid or other combustible materials is prohibited, provided that they cause degradation of the environmental quality, except with prior authorization from a state environmental agency, or in emergency health situations defined by the Health Department or by the Secretariat of Agriculture and Agrarian Reform. The installation and use of incinerators of any kind in residential or building buildings, as well as in residential areas, is prohibited.
