Abstract

This Law defines the legal basis of proclamation, functioning, transformation, termination of the functioning, protection and management of protected areas and aims at conservation and restoration (reproduction) of valuable natural complexes and species. It classifies protected areas as reserves, national parks, wildlife sanctuaries (game reserves) and nature monuments. Depending on the characteristics of valuable natural complexes and objects, natural monuments shall be classified in the following categories: (a) botanical (forest plots with valuable forest species, ancient parks, separate centuries-old or rare species of trees and their groups, areas with relict or particularly valuable vegetation, other valuable botanical objects); (b) hydrological (springs, streams and other valuable waterbodies and ecosystems associated therewith); (c) geological (some rare relief forms located in the natural terrain, mineralogical, paleontological and other unique geological environments). The scope of the system of protected areas shall be conservation of biological and landscape biodiversity and maintaining ecological balance on the national territory. Use restrictions shall be imposed on land under protected areas. Expropriation of land plots pertaining to protected areas and allotment thereof shall be authorized if the scope and terms of expropriation and allotment of the aforesaid land plots are compatible with protection regime of protected areas. Natural persons and legal entities have the right to take part in public participation related to discussions on draft of environmentally significant decisions related to protected areas, including drafts of the national strategy for development of the system of protected areas, state programs areas of development of the system of protected areas, schemes of rational location of protected areas of national significance, regional schemes of rational location of protected areas of local significance and protected area management plans. Reservation of land area to be designated as a protected area shall be performed in order to prevent loss of valuable natural complexes and objects as a result of economic and other activities. The general criteria for selecting natural areas to be declared a nature reserve, a national park, a wildlife sanctuary are the following: (a) the presence of typical and/or rare natural landscapes and/or habitats; (b) the presence of wildlife habitats and/or growth areas of wild plants belonging to species included in the Red Book of protected and endangered species of the Republic of Belarus and (or) species covered by international treaties of the Republic of Belarus; (c) the presence of places of regular nesting, wintering or stopover of migratory and wetland bird species during the period of migration of wetlands in number exceeding one percent of the number of national or European population of such species; (d) availability of annual concentration sites during seasonal migrations of at least 10,000 species of migratory waterfowl (waders, ducks, geese), and at least 500 species of gray cranes; (e) availability of spawning, feeding and migration sites of fish species included in the Red Book of the Republic of Belarus and/or species covered by international treaties of the Republic of Belarus; (f) availability of natural areas included in the national ecological network; and (g) availability of natural waterbodies, relief forms, unique or rare in origin, morphometric and/or other characteristics. This Law consists of XIV Chapters divided into 49 Articles. Chapter I lays down general provisions. Chapter II regards state management of protected areas. Chapter III regards participation of natural and legal persons in decision-making related to protected areas. Chapter IV regards scientific substantiation of protected areas. Chapter V regards planning of the development of protected areas network. Chapter VI establishes the procedure for proclamation, transformation and cessation of the functioning of protected areas. Chapter VII establishes regime of protection and management of protected areas. Chapter VIII regards administration of protected areas. Chapter IX regards protected areas of international significance and management thereof. Chapter X regards complex monitoring of ecosystems of protected areas and registration of protected areas. Chapter XI regards state programs related to protected areas and financing of protected areas. Chapter XII establishes the procedure of compliance with the legislation on protected areas. Chapter XIII establishes the procedure of liability and compensation. Chapter XIV lays down final provisions.
