Abstract

This Law, consisting of 14 articles, provides for the mandatory forestry reforestation within the State of Roraima. This Law establishes the obligation of forestry reforestation for natural or legal persons who exploit, use or transform forestry raw material or have authorization to suppress natural vegetation for alternative use of the soil, by planting suitable, exotic and/or native species. In particular, it establishes that anyone who exploits or suppresses native vegetation on public lands, as well as private forestry area under any regime, without authorization or in disagreement with said authorization, shall comply with the forest restoration. The holder of an authorization to suppress natural vegetation for alternative use of the soil, is exempted from complying with forest reforestation. Any forestry entities must license their activities in the competent environmental agency. Forest reforestation can be carried out by any of the following modalities: Planting in degraded areas, in their own lands or third parties, to meet the needs of the enterprise, through technical projects approved by the competent environmental agency of the National Environmental System (SISNAMA); Collecting the value corresponding to the replacement debt on behalf of the State Fund for the Environment and Water Resources (FEMARH), for environmental projects that seek to promote forest plantations; Purchase of replacement credit of an individual or legal entity accredited by the competent environmental agency and derived from a project, pursuant to the present and federal regulations.
