Abstract The Act consists of 8 Sections divided into 52 articles: (1) general provisions; (2) administrative and regulatory plenary powers; (3) issuance, modification, suspension and withdrawal of licences; (4) right of use of third party property; (5) generation, transmission, distribution, supply of electric energy and energy system management; (6) legal relationship between the participants of electric energy market; (7) rate management; and (8) conclusive and transitional provisions. This Law shall be applicable to: (a) energy generation; (b) hydropower and thermal power generation; (c) transmission of electric energy, including transboundary fluxes of energy; (d) electric energy distribution; (e) electric energy supply; (f) import and export of electric energy; (g) rate setting; (h) licensing of electric energy market; (i) electric energy marketing; (j) functioning of electric energy system; (k) safety and reliability of electric energy supply to consumers; and (l) protection of final consumers. Hydropower generation, transmission, distribution and supply shall be licensed. The authorized state institution carrying the function of licensing authority shall be Electric Energy Agency that shall issue separate licences for: (a) hydropower generation; (b) hydropower transmission; (c) hydropower distribution; and (d) licence for hydropower supply at controlled and uncontrolled pay rates.
