Abstract This Law, consisting of 62 articles divided into eleven Chapters and one Annex, provides for the Inter-Municipal Waterway Transportation System of Passengers and Vehicles within the State of Bahia (SHI). It regulates the organization, planning, supervision and police power of the above mentioned System. It is incumbent upon the State of Bahia to directly explore, or by means of concession or permit, these navigation services, providing for quality and a fair rate. The navigation service between two or more municipalities are regulated within the territorial limits of the State of Bahia, in a coastal strip up to 12 nautical miles from the coast, in waters of river beds, bays, creeks, lakes, lagoons, channels, and sheltered maritime waters, with origin, destination, tariff and defined schedules. The SHI services will be operationally planned, coordinated, controlled, granted, allowed, regulated and supervised by the State Agency for Regulation of Public Services of Energy, Transport and Communications of Bahia (AGERBA), an autonomous entity under special regime, linked to the Secretariat of Infrastructure (SEINFRA), subject to the jurisdiction of the maritime authority.
