Abstract This Law defines guidelines for the verification of the safety of dams of any nature and deposits for toxic industrial waste. It applies to private individuals and legal entities that own or legally hold dams of any nature and/or deposits of toxic industrial waste that are in the territory of the State. The execution of works and the installment of structures for dams and deposits of toxic industrial waste in the State are conditioned to the environmental licensing provided for in a specific law to the realization of a project that contains, at least: hydrological and meteorological study with a minimum recurrence period of twenty years and spatial coverage related to the hydrographic basin; geological study of the area in which the work will be installed; forecast of leakage or other overflow system capable of draining the maximum flood flow without compromising the stability of the dam or landfill; verification of the stability of the dam when submitted to the conditions caused by the maximum floods; forecast of waterproofing the bottom of the dam lake for the storage of toxic effluents and the base of deposit of toxic industrial waste.
