Abstract

This Law, consisting of 24 articles divided into five Chapters, approves the Legal Framework regulating Public-Private Partnerships. It aims at defining the general bases applicable to the privatization, designing, launching, modification, supervision and global monitoring of public-private partnerships and regulates the scope of application, including the setting up of special purpose companies, governance, risk sharing, etc. This Law applies to the Direct and the Indirect Administration of the State, so that they can be public partners. In addition, it applies to all partnerships in which the non-public partner equivalent is a private company, a cooperative or a private non-profit institution. The essential supporting bodies responsible for the State's decision-making process on Public-Private Partnership contracts concluded under this Law are determined by the Executive Power Holder.
