This Law enters into force on the day of its publication.
Abstract

This Law, consisting of 71 articles divided into 12 Chapters, creates the State Policy on Fisheries and Aquaculture within the State of São Paulo. The Policy establishes the administrative acts related to the above mentioned activities as follows. Concession: exploitation of public infrastructure, aquaculture in waters and public lands, for the installation of fixed traps in waters under state control; authorization: for transfer of permission and research; permission: fishing vessel and amateur fishing; license: professional fishing and professional aquaculture. The State Fisheries Policy is formulated, coordinated and implemented with the objective of promoting responsible fishing, planning, incentive and inspection of fishing activities, as well as the socio-economic, cultural and professional development, as well as the preservation and restoration of scientifically based aquatic ecosystems. The State is responsible to: promote the sustainable development of fishing activity as a source of food, employment and income generating activity, ensuring the rational use of fishing resources; optimize fishing and aquaculture sectors, in harmony with tourism and the preservation of the environment and biodiversity. The competent bodies shall establish measures to protect fauna and flora, such as: effluents from sewage networks and liquid or solid waste may only be discharged into waters upon the authorization of competent authority.
