Abstract

This Law regulates the relations between executive bodies, manufacturers, sellers (suppliers), developers, researchers, scientists and consumers of genetically modified organisms and products manufactured using technologies that involve their development, creation, testing, research, transportation, import, export, placing on the market, release into the environment and use in Ukraine with biological and genetic safety. This Law does not apply to humans, tissues and individual cells within the human body. The following activities shall be regulated by this Law: (a) genetic engineering activities carried out in a closed system; (b) genetic engineering activities carried out in an open system; state registration of GMOs; (c) introduction into circulation and subsequent circulation of GMOs and products produced with their use; and (d) export, import and transit of GMOs. Products that must registered in the State registers of GMOs: (a) varieties of agricultural plants and breeds of animals created on the basis of GMOs; and (b) GMO-containing foodstuffs; and (c) GMO-containing animal feedstuffs. State registration is carried out for a period of five years at no cost. Renewal of registration is carried out in the same order as registration. State registration of GMOs may be refused if scientifically substantiated information is received regarding their danger to human health or the environment when used for the intended purpose. Genetically modified varieties of plants may be subject to restrictions on their cultivation on land whose list is defined the central executive body in the field of environmental protection. This Law contains VI Sections divided into 22 Articles. Section I lays down general provisions. Section II regards law enforcement. Section III regards GMO management and genetic engineering activities in a closed system. Section IV regards regulation of genetic engineering in an open system and state registration of GMOs. Section V regards use, transportation, storage and disposal of GMOs. Section VI lays down final provisions.
