Abstract This Law, consisting of 22 articles divided into four Chapters, provides for the Plant Sanitary Protection within the State of Espírito Santo. The State is responsible for promoting the plant protection in the State of Espírito Santo, through procedures aiming to safeguard the quality of the environment and human health. It also creates the Institute for Agricultural and Forest Protection of Espírito Santo (IDAF) entitled to implement technical regulation and measures as follows: coordinate, execute and supervise the actions of pest prevention and control and maintenance of the plant health of economic importance to the State; establish procedures, practices, prohibitions etc. necessary to the Plant Protection; implement state and/or regional programmes for pest control; promote, in partnerships with representatives of the state productive chains and Rural Extension Service, courses, campaigns and actions for plant health education to the rural producers and people involved in agricultural activities; register professionals authorized to issue phytosanitary documents, production units, consolidation and other registers that may be regulated by normative acts; prohibit transit and/or public or private areas, when the measure justifies the prevention or eradication of pests of economic importance; supervise plant product trade in the state; apply quarantine for pest control; release or not the transit permit to infected and infested plants and their products, once disinfected or sterilized according to specific legislation of the pest; eliminate plants and their products, when infected or infested by quarantine or other pests.
