This Law enters into force on the date of its official publication.

Abstract

Article 5 shall be amended to add the following wording: “This Article establishes the competence of the authorized state body as follows: “The authorized state body for the protection of the ozone layer shall be responsible for: (a) organization and coordination the development and implementation of state programs for the protection of the ozone layer; (b) in the presence of a license, with the exception of cases envisaged for by the acting national legislation, issues one-time permits for the export and import of ozone-depleting substances and (or) products containing ozone-depleting substances; (c) performance of state control over the protection of the ozone layer, including consumption of ozone-depleting substances, as well as control over the development and implementation of measures for the timely collection and storage of residual amounts of ozone-depleting substances for recycling or disposal purposes; (d) issuance to legal persons- entrepreneurs, and individual entrepreneurs mandatory instructions for eliminating the identified violations of the national legislation related to protection of the ozone layer; (e) decision-making on limiting or suspending the operation of separate plants, workshops and other facilities, if their operation is performed in violation of the national legislation on the protection of the ozone layer; (f) submittal of proposals to the relevant state bodies, local self-government bodies and (or) to the court to terminate the activities of business entities, regardless of their forms of ownership, and individual entrepreneurs in case of repeated and flagrant violations of the national legislation on the protection of the ozone layer; (g) determination of the procedure for the performance of business practices in relation to accounting for the consumption of ozone-depleting substances and their reporting on the handling of ozone-depleting substances; (h) keeping records of residual amounts of ozone-depleting substances in Turkmenistan until their final withdrawal from circulation; (i) performance of international cooperation in the field of protection of the ozone layer; and (j) performance of other plenary powers in the field of protection of the ozone layer in accordance with the national legislation”.
